Village of El Portal Candidate Qualifying Information

ELECTION November 3, 2020

This information is for candidates who wish to run in this year’s municipal election. The qualifying period for these offices will begin at 12:00 noon on Monday, August 10, 2020, and end at 12:00 noon on Friday, August 14, 2020. The following document contains the links to the different forms you may need. I’ve also posted it to the Village’s website, under the Clerk’s department, for your convenience.

UPON ANNOUNCING: These two documents must be first turned in to the Clerk’s Office to start candidate qualifying. Please make an appointment with the Clerk’s Office to turn them in. yjacobi@villlageofelportal.org

  1. Appointment of Campaign Treasurer and Designation of Campaign Depository: FORM DS-DE 9
    A Campaign Account must be opened. Please note that the name on the account must be in this format: Name/”Campaign Account”. The State of Florida Assessment fee of 1% of annual salary ($31.00) is payable by check to the Village of El Portal from the Campaign Account. Pay filing fee with a check drawn on Campaign Account as prescribed in Florida Statutes, Chapter 106. No personal checks will be accepted. Only candidates who withdraw prior to the end of the qualifying period will be refunded their qualifying fee. Anyone who withdraws after that time will not have their qualifying fee refunded.
  2. Statement of Candidate: FORM DS-DE 84
    Each candidate must file a statement with the qualifying officer within 10 days after the Appointment of Campaign Treasurer and Designation of Campaign Depository is filed. Willful failure to file this form is a first degree misdemeanor and a civil violation of the Campaign Financing Act which may result in a fine of up to $1,000, (ss. 106.19(1)(c), 106.265(1), Florida Statutes).

    Section 5.01. – Elections. (d)Available positions to be filled on the Village council shall be classified into seats, which shall be consecutively numbered. Candidates qualifying for office shall specify the seat for which they will run. The office of Mayor shall be a separate office and a separate seat, and candidates desiring to run for the Office of Mayor shall so specify in their qualifying papers.
  • Chapter 6 – ELECTIONS
  • Section 2.03. – Election and term of office.
    Each councilperson (including the Mayor) shall be elected from a “seat” as defined herein, to serve a term of two years.
  • Section 2.04. – Qualifications.
    A candidate for Councilperson (including Mayor) shall qualify for election by the filing of a written petition for candidacy with the Clerk of the Village at such time and in such manner as may be prescribed by ordinance and the payment to the Village Clerk of a sum to be prescribed by resolution or ordinance. The petition shall be signed by at least fifteen (15) duly registered electors of the Village, in a form to be prescribed by ordinance. Only electors of the Village who have resided continuously in the Village for at least six (6) months preceding the date of the election shall be eligible to hold the office of Councilperson (including Mayor).

ALL seats are up for election. Please make sure you have indicated the correct seat number on your documents. The Clerk’s Office will NOT make any changes to the form.

The following forms must be completed and filed with the Village Clerk’s Office beginning August 10, 2020 and before August 14, 2020, at 12 noon, in order to qualify as a candidate for the Municipal election on Tuesday, November 3, 2020. You will want to familiarize yourself with this document as it contains answers to many of the questions you may ask. As always, I am here to answer your questions and help any of you who wish to announce their candidacy this year. It’s important that you understand the deadlines and that you come in to see me so that I may go over the proper forms and reporting requirements with you.

  1. Loyalty Oath and Candidate Oath for Non-Partisan Office: FORM DS-DE 25
    Must be notarized
  2. Financial Disclosure: Form 1, Statement of Financial Interests
    Along with any other forms YOU MAY NEED TO FILE IN ORDER TO COMPLY WITH THE ETHICS LAWS (PG. 6 of this form will describe those forms)
  3. Voluntary Fair Campaign Practices Waiver: MD Ethics Commission
    As is stated in the title, this form is voluntary, but it is recommended.
  4. Petition Form with signatures (must be obtained from Village Clerk)
    Qualification of candidates; form of petition: Time Sensitive – must be certified by Miami-Dade Department of Elections

    Those persons desiring to have their names placed upon the voting machines as candidates for the [portion] of village mayor or councilperson shall, not later than 12:00 p.m. (noon) on August 14, 2020, prior to the election, obtain from and file with the village clerk a petition signed by 15 qualified electors of the village, and such petition shall be accompanied by a qualifying fee of $1.00 and a state assessment fee of $30.00, which is 1 percent of the annual salary of $3,000.00 which shall be paid into the treasury of the village.
